IYKYK Beverages, LLC. (“IYKYK Beverages,” “we,” “us,” or “our”) provides our services through our website located at https://enjoyiykyk.com (the “Site”). By accessing or using the Site, you agree to be bound by these Terms of Service. If you do not agree, you may not use the Site.

We may modify these Terms of Service at any time. Changes will be posted on this page with the revised date. Continued use of the Site after changes are posted constitutes your acceptance.

PRODUCT NOTICE

AGE VERIFICATION PROCESS

IYKYK is dedicated to promoting the responsible sale and consumption of our products. We have carefully crafted our beverages exclusively for individuals aged 21 and over. We are focused to ensure our age verification policy adheres to all federal, state, and local regulations regarding the sale of age-restricted beverages. We reserve the right to verify the age of any customer before completing a transaction.

IYKYK implements the following age verification measures:

Any transaction that appears suspicious or cannot be verified will be canceled at our discretion.

We strictly forbid the purchase or attempted purchase of our products for or by anyone under the age of 21.

THC Content: IYKYK products available for shipping (in select states and for select products) contain less than 0.3% Delta-9 Tetrahydrocannabinol (THC) per dry weight derived from industrial hemp.

THC Levels: THC amounts listed on products are based on the time of testing and may change over the product’s life. IYKYK makes no claims about THC amounts at the time of use or purchase.

Health Claims: These products do not claim to diagnose, treat, cure, or prevent any disease and have not been evaluated or approved by the United States Food and Drug Administration (FDA).

  • May not be sold to persons under 21.
  • Must be 21+ to possess or consume.
  • Do not drive or operate machinery after use.
  • Not intended to diagnose, treat, cure, or prevent any disease.
  • The FDA has not evaluated this product for safety or efficacy.
  • Consult your physician before use if you are pregnant or taking any medication.
  • Products contain THC, consumption of this product may result in a failed drug test.

USE OF SERVICE

SHIPPING POLICY

Shipping Methods: Standard ground shipping within the US.

Shipping Time: Your order will typically ship within 1-2 business days. Please allow additional time for transit.

Shipping Costs: Flat fee of $10 for orders up to $99. Orders over $100 ship free.

Shipping Restrictions: We only ship to the continental United States and do not ship to the following states:

Tracking Information: All orders include a tracking number which will be emailed to the one provided in your order or subscription.

REFUND POLICY: Hemp-Derived Beverages

No Refunds: Due to the nature of our products, we do not accept refunds. All sales are final.

Satisfaction Guarantee: We stand by our products and want you to be satisfied with your purchase. If you have any concerns or issues with your order, please contact our customer service team at comeon@enjoyiykyk.com.

REFUND POLICY: Merchandise & Other Goods

Satisfaction Guarantee: We stand by our merchandise and want you to be satisfied with your purchase. If you are not satisfied with your merchandise, please contact us within 30 days of receiving your order.

Refund Eligibility: To be eligible for a refund, merchandise must be unused and in the same condition that you received it. It must also be in the original packaging.

Refund Process: To initiate a refund for merchandise, please contact our customer service team at comeon@enjoyiykyk.com with your order number and reason for the refund. Once your return is received and inspected, we will notify you of the approval or rejection of your refund.

Refunds (if applicable): Once approved, your refund will be processed, and a credit will automatically be applied to your original method of payment within a certain number of days.

Shipping Costs: Shipping costs are non-refundable.

SUBSCRIPTIONS & CANCELLATION POLICY

Subscription Plans: Weekly, monthly, and quarterly options available.

Payment Terms: Fees billed no more than 24 hours prior to  each shipment.

Managing Subscription: Change schedule, payment info, or plan through your account.

Cancellation Policy: Cancel anytime via your account, at least 24 hours before the next shipping date. Orders cannot be canceled once processed.

Promotional Offers: Some promotions may not be used with a subscription.

PAYMENT PROCESSING

We use third-party payment processors for all transactions. By using our payment functions, you agree to the terms and conditions of the applicable payment processor. We are not liable for any payments processed through these services. Prices are exclusive of shipping, taxes, and any additional duties unless specified.

ORDERS AND ACCEPTANCE

All orders are subject to availability and acceptance. We may reject orders suspected of fraud or unauthorized use. We reserve the right to change product descriptions, specifications, and prices without notice. Information on our site may not always be current or accurate, and we reserve the right to correct any errors.

COMMERCIAL USE

The service is for personal use only. Do not use or exploit any part of the service for commercial purposes without express authorization.

MOBILE SERVICES AND SOFTWARE

Mobile Services

Our services are accessible via mobile devices. Your carrier’s standard charges, data rates, and other fees may apply. Not all mobile services work with all carriers or devices.

Telephonic Communications Services

By providing your telephone number, you consent to be contacted by us or our partners for marketing, solicitation, or informational purposes. Standard message and data rates apply. To stop receiving messages, text “STOP” in response to any message.

‘Ownership’ Restrictions

The technology and software underlying our service are the property of IYKYK Beverages and its licensors. You agree not to copy, modify, reverse engineer, or transfer any rights in the software.

Special Notice for International Use; Export Controls

IYKYK Beverages is based in the United States. You are responsible for complying with local laws if you access our service outside the U.S.. Software and data transmission are subject to U.S. export controls.

Open Source Software 

Our software may include open-source software subject to its own license terms, available upon request.

INTELLECTUAL PROPERTY RIGHTS

Service Content: The Service may contain content or features protected by copyright, patent, trademark, trade secret, or other proprietary rights. You agree not to modify, copy, frame, scrape, rent, lease, loan, sell, distribute, or create derivative works based on the Service or its content, except for your own User Content.

Trademarks: The IYKYK Beverages name and logos are trademarks of IYKYK Beverages. Other company, product, and service names used on the Service may be trademarks of their respective owners. Nothing in the Service grants you any right to use any trademarks displayed on the Service without prior written permission.

User Content: By uploading User Content, you represent that you own all rights to it and grant IYKYK Beverages a non-exclusive, worldwide, royalty-free, perpetual license to use your User Content in connection with the Service. You are solely responsible for your User Content’s accuracy, quality, legality, and appropriateness.

Usage Data: We may derive statistical and usage data from your use of the Service and use it in accordance with applicable laws and our Privacy Policy.

Submissions: Any feedback, suggestions, or other information provided to us is non-confidential and may be used by IYKYK Beverages without acknowledgment or compensation.

INDEMNIFICATION

To the extent permitted by law, you agree to defend, indemnify, and hold harmless IYKYK Beverages and its affiliates, officers, employees, directors, service providers, licensors, and agents from any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, User Content, violation of these Terms of Service, or violation of any rights of another. IYKYK Beverages reserves the right to assume the exclusive defense and control of any matter subject to indemnification.

DISCLAIMER OF WARRANTIES

The Service is provided “as is” and “as available.” IYKYK Beverages disclaims all warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will meet your requirements, be uninterrupted, timely, secure, or error-free, or that the results obtained will be accurate or reliable.

LIMITATION OF LIABILITY

IYKYK Beverages is not liable for any indirect, incidental, special, consequential, or exemplary damages, or damages for loss of profits, goodwill, use, or data (even if we have been advised of the possibility of such damages) resulting from your use of the Service. Our total liability to you for all damages will not exceed the amount you paid IYKYK Beverages in the last six months or $100, whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. Accordingly, some of the above limitations may not apply to you. If you are dissatisfied with any part of the Service, your sole remedy is to discontinue use of the Service.

For users in New Jersey, these sections are intended to be as broad as permitted under New Jersey law. If any part of these sections is invalid under New Jersey law, the remaining portions will remain valid.

DISPUTE RESOLUTION BY BINDING ARBITRATION

PLEASE READ THIS SECTION CAREFULLY AS IT AFFECTS YOUR RIGHTS.

Agreement to Arbitrate

You agree that any disputes or claims arising between you and IYKYK Beverages will be resolved exclusively through final and binding arbitration, except for individual claims in small claims court. By agreeing to arbitration, you waive the right to a jury trial or to participate in a class action. The Federal Arbitration Act governs this Arbitration Agreement.

Prohibition of Class Actions

You and IYKYK Beverages agree that claims may only be brought on an individual basis. The arbitrator cannot join more than one person’s claims or preside over any class action. Relief awarded by the arbitrator can only apply to the individual party.

Pre-Arbitration Dispute Resolution

Most disputes can be resolved by contacting customer support at [your email]. If unresolved, a written Notice of Dispute must be sent. If the dispute is not resolved within 60 days, arbitration may proceed.

Arbitration Procedures

Arbitration will be conducted according to the American Arbitration Association’s (AAA) rules, including Consumer Arbitration Rules, with any inconsistencies resolved by this Arbitration Agreement. The arbitrator can award the same individual relief as a court. Hearings will be in a convenient location, based on agreement or determination by AAA. Claims under $10,000 may be resolved based on documents, telephonic or in-person hearings.

Costs of Arbitration

Arbitration fees will follow AAA rules, with potential adjustments for inability to pay. IYKYK Beverages may cover additional fees if necessary to ensure fairness.

Confidentiality

All arbitration proceedings and decisions are confidential.

Severability

If any part of this Arbitration Agreement (except Prohibition of Class Actions) is found invalid, it will be replaced with a valid provision reflecting the intention. If Prohibition of Class Actions is invalid, the entire Arbitration Agreement is void, except for claims involving public injunctive relief.

Future Changes

Any changes to this Arbitration Agreement can be rejected within 30 days by notifying IYKYK Beverages, otherwise, they will take effect.

Termination

IYKYK Beverages may suspend or terminate your account or use of the Service at its discretion for any reason, including inactivity or violation of these Terms. Suspected fraudulent, abusive, or illegal activities may be referred to law enforcement. IYKYK Beverages can discontinue the Service at any time without notice. You agree that termination may occur without prior notice and that IYKYK Beverages will not be liable to you or any third party for termination of your access.

General

These Terms of Service, together with any incorporated terms, constitute the entire agreement between you and IYKYK Beverages. They supersede any prior agreements. These Terms are governed by the laws of California, and any disputes not subject to arbitration will be resolved in the state courts of Sutter County, California. Failure to enforce any right or provision will not be considered a waiver. If any provision is found invalid, the remaining terms will remain in effect. Claims must be filed within one year. Notices may be sent via email or regular mail. IYKYK Beverages will not be liable for delays caused by events beyond its control.
